Terms of Use (EULA)

This End User License Agreement ("Agreement" or "Terms of Use") is a legal agreement between you ("you" or "User") and Global SAR Hub SAS, a French company headquartered at 60 rue François 1er, 75008 Paris, France ("Global SAR Hub", "we", "us" or "our"). It governs your use of the website www.globalsarhub.com and the CH16 mobile application available on the Apple App Store. By accessing the website or downloading, installing, or using the CH16 application, you agree to be bound by these Terms.

By using our website or our mobile application, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the website or the application.

2. License Grant

Global SAR Hub grants you a limited, non-exclusive, non-transferable, revocable license to use the CH16 mobile application for your personal, non-commercial use, strictly in accordance with these Terms and the Apple Media Services Terms and Conditions. This license is granted by Global SAR Hub and not by Apple. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the application.

CH16 by Global SAR Hub is a maritime safety companion application designed to assist mariners. Its main features include:

CH16 is a companion tool and is not a substitute for professional maritime training, certified navigation equipment, or official safety procedures. The information provided by the application (including RCC contact details, SRR boundaries, distress message formats, and Passage Plan delivery) is provided "as is" without warranty of any kind. In a real emergency at sea, you must always rely on certified GMDSS equipment, VHF radio, EPIRB, and direct contact with maritime authorities. Global SAR Hub, its directors, employees, and partners shall not be liable for any loss, damage, injury, or death resulting from reliance on the application.

5. Subscriptions and In-App Purchases

CH16 offers a free tier with limited features and a paid "CH16 Pro" tier with two purchase options:

Payment will be charged to your Apple ID account at confirmation of purchase. The monthly subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate. You can manage and cancel your subscriptions at any time by going to your App Store account settings after purchase. No cancellation of the current subscription is allowed during the active subscription period. Refunds, where applicable, are handled directly by Apple in accordance with the Apple Media Services Terms and Conditions.

Prices may vary by region and are displayed inside the application before purchase. Free trials, if offered, will automatically convert to a paid subscription unless cancelled at least 24 hours before the end of the trial period.

6. User Accounts and Sign in with Apple

To submit a Passage Plan, you must sign in anonymously using "Sign in with Apple". We never receive your name or your real Apple email address — only an anonymized hashed identifier used to enforce a fair-use quota of 2 Passage Plan submissions per 24 hours per user. You can revoke this access at any time via iOS Settings > Apple ID > Sign-In with Apple > CH16.

All content, trademarks, logos, software, and data made available through the website and the CH16 application are the property of Global SAR Hub or its licensors and are protected by international copyright and intellectual property laws. The directory of Rescue Coordination Centers and SRR boundaries is compiled and maintained by Global SAR Hub from publicly available sources and is provided for informational purposes only.

9. Privacy

Your use of the website and the CH16 application is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using our services, you consent to the processing of your data as described in the Privacy Policy.

10. Third-Party Services

The CH16 application uses the following third-party services: Apple App Store and Sign in with Apple (Apple Inc.), RevenueCat (subscription management), Google AdMob (advertising for free users only, with App Tracking Transparency consent), and OpenFreeMap (base map tiles). Each of these providers has its own terms and privacy policy, which you should also review.

11. Disclaimer of Warranties

The website and the CH16 application are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. Global SAR Hub does not warrant that the application will be uninterrupted, error-free, or free of viruses or other harmful components.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Global SAR Hub, its directors, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of life, personal injury, or property damage, arising out of or in connection with your use of, or inability to use, the website or the CH16 application. In any event, the total aggregate liability of Global SAR Hub shall not exceed the amount you paid (if any) for the CH16 application in the twelve (12) months preceding the claim.

13. Apple-Specific Provisions

You acknowledge that these Terms are concluded between you and Global SAR Hub only, and not with Apple Inc. Apple is not responsible for the application or its content. In the event of any failure of the application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the application. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

14. Termination

We may suspend or terminate your access to the website or the CH16 application at any time, without notice, if you breach these Terms or engage in any conduct we consider harmful to other users or to our services. Upon termination, your right to use the application will immediately cease. The provisions of these Terms which by their nature should survive termination shall survive (including, without limitation, the disclaimers, limitation of liability, and intellectual property clauses).

We may update these Terms from time to time. The "last updated" date will be revised accordingly. Continued use of the website or the application after any modification constitutes acceptance of the revised Terms. Material changes will be notified through the application or via our website.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of France. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Paris, France, except where mandatory consumer protection laws of your country of residence provide otherwise.
